According to a recently published study, approximately half of those who currently smoke in Norway have little or no desire to quit despite a hostile regulatory and socio-cultural climate for smoking. On this background, we discuss some challenges that regulators will face in a further tightening of structural measures to curb smoking.
Main body
Central to our discussion is the research literature concerned with the concept of state-paternalism in tobacco control—the line between an ethically justified interference with the freedom of those who smoke and an exaggerated infringement disproportionate to the same people’s right to live as they choose. In countries with an already advanced infrastructure for tobacco control, this dilemma might become quite intrusive for regulators. We ask that if people, who smoke are aware of and have accepted the risks, are willing to pay the price, smoke
exclusively in designated areas, and make decisions uninfluenced by persuasive messages from manufacturers—is a further tightening of anti-smoking measures still legitimate? Strengthening of the infrastructure for tobacco control can be seen as a “help” to people who—due to some sort of “decision failure”—continue to smoke against their own will. However, for those who want to continue smoking for reasons that for them appear rational, such measures may appear unwanted, punitive, and coercive. Is it within the rights of regulators to ignore peoples’ self-determination for the sake of their own good? We problematize the “help” argument and discuss the authorities’ right to elevate the zero-vision of smoking as universally applicable while at the same time setting up barriers to switching to alternative nicotine products with reduced risk.
Conclusion We recommend that a further intensification of smoking control in countries that already have a welldeveloped policy in this area requires that regulators start to exploit the opportunity that lies in the ongoing diversification of the recreational nicotine market.

We conducted a population-based telephone survey of 4,977 females, ascertaining factors associated with smoking bans. Odds ratios and 95% confidence intervals were derived using unconditional logistic regression. A complete home smoking ban was reported by 59.5% of French, 63.5% of Irish, 61.3% of Italian, 74.4% of Czech and 87.0% of Swedish females. Home smoking bans were associated with younger age and being bothered by secondhand smoke, and among smokers, inversely associated with greater tobacco dependence. Among nonsmokers, bans were also related to believing smoking is harmful (OR 1.20, 95% CI 1.11-1.30) and having parents who smoke (OR 0.62, 95% CI 0.52-0.73). Workplace bans were reported by 92.6% of French, 96.5% of Irish, 77.9% of Italian, 79.1% of Czech and 88.1% of Swedish females. Workplace smoking bans were reported less often among those in technical positions (OR 0.64, 95% CI 0.50-0.82) and among skilled workers (OR 0.53, 95% CI 0.32-0.88) than among professional workers. Workplace smoking bans are in place for most workers in these countries. Having a home smoking ban was based on smoking behaviour, demographics, beliefs and personal preference. [TABAC] législationIndex. décimale : TA 9.3 Législation européenne et mondiale Résumé : L’Initiative de l’Organisation pour un monde sans tabac de l’OMS annonce le troisième volume de la série de rapports techniques du Groupe d’étude de l’OMS sur la réglementation des produits du tabac (TobReg) sur les fondements scientifiques de la réglementation des produits du tabac. Cette série de rapports techniques de l'OMS met à disposition les conclusions d'un groupe international d'experts qui fournissent à l'OMS les derniers avis scientifiques et techniques dans le domaine de la réglementation des produits.
Le troisième rapport présente les conclusions et les recommandations des membres du Groupe d’étude de l’OMS sur la réglementation des produits du tabac lors de sa cinquième réunion, au cours desquelles il a examiné deux documents de référence spécialement commandés pour la réunion et traitant respectivement des deux thèmes suivants: .
Dispositifs conçus pour délivrer de la nicotine au système respiratoire dans lesquels le tabac n’est pas nécessaire pour leur fonctionnement.
Fixation de limites réglementaires pour les substances cancérogènes dans le tabac sans fumée.
Les recommandations du groupe d'étude relatives à chaque thème figurent à la fin de la section consacrée à ce thème. Ses recommandations générales sont résumées à la section 4.
Le Groupe d’étude souhaite que cette nouvelle série de recommandations soit utile aux États Membres de l’OMS et aux décideurs et régulateurs nationaux pour la formulation de la politique de lutte antitabac. Design Comparisons before and after the legislation in intervention and control regions.
Setting Public houses in three areas in the Republic (intervention) and one area in Northern Ireland (control).
Participants 329 bar staff enrolled in baseline survey; 249 (76%) followed up one year later. Of these, 158 were non-smokers both at baseline and follow-up.
Main outcome measures Salivary cotinine concentration, self reported exposure to secondhand smoke, and respiratory and sensory irritation symptoms.
Results In bar staff in the Republic who did not themselves smoke, salivary cotinine concentrations dropped by 80% after the smoke-free law (from median 29.0 nmol/l (95% confidence interval 18.2 to 43.2 nmol/l)) to 5.1 nmol/l (2.8 to 13.1 nmol/l) in contrast with a 20% decline in Northern Ireland over the same period (from median 25.3 nmol/l (10.4 to 59.2 nmol/l) to 20.4 nmol/l (13.2 to 33.8 nmol/l)). Changes in self reported exposure to secondhand smoke were consistent with the changes in cotinine concentrations. Reporting any respiratory symptom declined significantly in the Republic (down 16.7%, −26.1% to −7.3%) but not in Northern Ireland (0% difference, −32.7% to 32.7%). After adjustment for confounding, respiratory symptoms declined significantly more in the Republic than in Northern Ireland and the decline in cotinine concentration was twice as great.
